4.7 Within 14 days of opening your MDF AG Account you may close it at no cost by contacting our customer support team at compliance@onramp.exchange. If you have uploaded funds into your account, you may be required to provide identity documents before withdrawing those funds. Fees and charges for transactions carried out prior to closure, including those not yet completed, are non-refundable.

5.2 Your account is denominated in a currency of your choice from those made available by MDF AG from time to time.

5.3 Your account does not expire but will not earn any interest on balances held.

5.5 Your MDF AG Account is not a bank account. In the unlikely event that MDF AG becomes insolvent, you may lose any balance held in your account. Your account is not covered by any deposit protection scheme.

5.6 Your MDF AG Account belongs to the registered account holder. No other person has any rights in relation to funds or Crypto-Assets held in your account, except in cases of succession under applicable law. You may not assign or transfer your account or any rights under these Terms to any third party.

5.7 Your account may be subject to transaction limits depending on your country of residence, your verification status, and other factors determined by us from time to time.

6. Maintaining Your MDF AG Account

6.1 You must ensure that all information recorded on your MDF AG Account remains accurate and up to date. We are not liable for any loss arising from your failure to keep your information current. We may ask you at any time to confirm the accuracy of your information or to provide supporting documents.

7.2 You should change your password regularly. Do not choose a password that could be guessed based on personal information about you. Never allow anyone else to access your account or to observe you accessing it.

7.3 If you believe your account, login details, or password have been lost, stolen, or compromised in any way, you must change your password immediately and contact our customer support without delay at compliance@onramp.exchange. Failure to notify us promptly may affect your ability to recover losses resulting from any unauthorised use.

7.4 If you suspect that your account has been accessed without authorisation, you should also report the matter to the relevant authorities.

7.5 We may suspend or restrict your account if we have reasonable grounds to believe that its security has been compromised or that unauthorised or fraudulent use has occurred or is likely. We will notify you of any suspension and the reasons for it as soon as we are able to do so, unless doing so would be unlawful or would compromise our security interests.

PART 3 — TRANSACTIONS AND PAYMENTS

9. Buying and Selling Crypto-Assets

9.1 You may purchase supported Crypto-Assets by logging into your MDF AG Account and following the instructions on our platform. Available payment and upload methods are displayed within your account and may vary depending on your country of residence and verification status.

9.2 You may be asked to answer security questions or complete other steps that we or any applicable payment service provider reasonably requires in order to authorise a transaction.

9.3 If you use a payment method that is subject to the possibility of a chargeback (such as a credit or debit card or direct debit), you agree that you will not initiate a chargeback except in cases of genuinely unauthorised use of the payment method or a breach of these Terms by us that would entitle you to a refund.

9.4 We will refund any past recurring payment initiated by or through a merchant where (a) the original authorisation was not given for the specific amount, and (b) the amount charged exceeded what you could reasonably have expected based on your previous spending pattern and the circumstances. Refund requests must be submitted within 8 weeks of the debit date. We will respond within 10 business days of receiving a complete request.

9.5 Uploaded funds will be credited to your account after receipt. Some methods, such as card payments, may appear to credit immediately but remain subject to reversal if actual funds are not received within a reasonable time. In such cases we reserve the right to debit your account for the reversed amount.

9.6 You must not make any upload using a payment method of which you are not the named holder. Any such attempt will be treated as a fraudulent act. If we are required to return funds uploaded from a payment method not in your name, we may charge an administration fee of CHF 15 per return.

9.7 Your account may be subject to upload limits based on your verification status and applicable requirements. These limits are displayed in your account profile.

9.8 Uploads are subject to our applicable fees including currency conversion fees where relevant. Please refer to our fee schedule on our website.

9.9 Cash uploads are not accepted.

10. Withdrawing Funds

10.1 You may request a withdrawal of all or part of the funds or Crypto-Assets held in your MDF AG Account at any time by logging into your account and selecting your preferred withdrawal method. Withdrawal methods are provided at least in part by third-party financial institutions. We do not guarantee the availability of any particular withdrawal method and may change or discontinue a method at any time, provided that at least one withdrawal method remains available to you.

10.2 Your account is subject to withdrawal limits adjusted dynamically based on the verification documentation we hold for you. You can view your applicable limits at any time in your account profile. You should confirm that your withdrawal limits meet your requirements before uploading funds.

10.3 If your withdrawal request exceeds your current limit, we may ask you to provide additional identity and address verification documents before processing the withdrawal.

10.4 Withdrawals are subject to fees including currency conversion fees where applicable. Please refer to our fee schedule on our website.

10.5 You must not make a withdrawal to a bank account or payment method of which you are not the named holder. Any attempt to do so will be treated as a fraudulent act. If we are required to investigate a withdrawal to an account not in your name, we may charge an administration fee of up to CHF 15.

10.6 You must ensure that all payment details you enter when requesting a withdrawal are accurate and complete, including account number, IBAN, and BIC/SWIFT where applicable. We are not liable for funds sent to a wrong account as a result of incorrect details provided by you. If you have provided incorrect details, you may contact us for assistance, but we cannot guarantee recovery and may charge an administration fee of up to CHF 35 for any reclaim attempt.

11. Placing Orders

11.1 By placing an Order through our platform, you confirm that you are of legal age in your country of registration and have the legal capacity to enter into binding contracts.

11.2 To authorise a payment or transaction you are required to confirm using your login credentials. We may ask additional security questions relating to you or your account. If your account uses additional security features, you must follow the instructions provided for those features.

12. Receiving Funds

12.1 If you receive a deposit into your MDF AG Account, we will send you a notification and display the payment as a transaction in your transaction history, together with the date, applicable fees, and any exchange rate applied. Each transaction is assigned a unique transaction reference.

12.2 A credit shown in your account does not guarantee that the underlying transaction cannot be reversed. We reserve the right to reverse a deposit if the payer or their payment provider has initiated, or is likely to initiate, a chargeback or other reversal of the original payment.

12.3 You should regularly reconcile received payments against your own records.

13. Exchange Rates

13.1 Exchange rates applied to transactions are determined by reference to prevailing market rates plus a transaction margin. The applicable margin is blended into the exchange rate displayed at the time of your transaction.

13.2 Exchange rates may change at any time without prior notice. We are not liable for any loss arising from movements in exchange rates.

13.3 MDF AG is not liable for any loss resulting from a transaction submission that contains incorrect account details. It is your sole responsibility to ensure that all account details provided to us are accurate.

14. Fees and Pricing

14.1 Our standard fees are set out in your agreement or in the fee schedule available on our website. We reserve the right to revise our fees at any time prior to accepting an Order.

14.2 Certain transactions may also attract additional third-party charges from banking partners, payment networks, or other intermediaries. These charges vary by location, currency, and transaction routing and are passed through to you at cost. Where known in advance we will notify you; where they cannot be determined in advance we will communicate them as soon as practicable.

14.3 In certain circumstances, such as significant changes in currency exchange rates or costs beyond our reasonable control, we may revise a quoted price after accepting an Order. In such cases you will have the right to cancel your Order.

PART 4 — PROHIBITED TRANSACTIONS AND RESTRICTED USE

15. Prohibited Transactions

15.1 You must not use your MDF AG Account to send or receive payments in connection with any of the following:

  • Tobacco products;
  • Prescription drugs or controlled substances;
  • Weapons, including knives, firearms, or ammunition;
  • Unauthorised satellite or cable television descramblers;
  • Pornographic or adult material;
  • Material that incites violence, hatred, or discrimination, or that is otherwise unlawful;
  • Counterfeit goods or documents;
  • Unlicensed or illegal lottery or gambling services;
  • Unregistered charitable services;
  • Multi-level marketing, pyramid schemes, or other fraudulent investment programmes;
  • Goods or services that infringe third-party intellectual property rights;
  • Any other goods or services that are prohibited under applicable law or under any acceptable use policy published on our website from time to time.

15.2 You must not use your MDF AG Account to make or receive payments to or from persons or entities offering illegal gambling services of any kind.

15.3 You must not use our services if you are resident in a country from which we have restricted or suspended services. A current list of restricted countries is set out in clause 16 of these Terms. This list is reviewed and updated regularly and may change at any time. We may suspend or close your account if we believe we are required to do so in order to comply with applicable requirements or the recommendations of a relevant authority.

15.4 You must not use your MDF AG Account for any fraudulent, unlawful, or abusive purpose, including money laundering or terrorist financing. We will report any suspicious activity to the relevant authorities.

15.5 Certain categories of business require our prior written approval before you may accept payments through your account. These include, among others: money exchange or remittance businesses; charitable or not-for-profit organisations; businesses dealing in precious metals, jewels, or stones; live-streaming businesses; and businesses supplying alcohol or dietary supplements. We reserve the right to reject these transactions even if written approval is requested. We reserve the right to add further categories to this list.

15.6 If you conduct or attempt to conduct a prohibited transaction, or a transaction requiring approval that has not been granted, we reserve the right to: reverse the transaction; suspend or close your account; report the matter to relevant authorities; and/or claim damages. We may additionally charge an administration fee of up to CHF 175.

15.7 It is your responsibility to ensure that all transactions you carry out through our platform comply with applicable laws. The fact that a counterparty accepts payments through MDF AG does not indicate the legality of their goods or services. If you are in any doubt as to the legality of a transaction, you should not proceed.

17.2 Refunds will be made to the same source from which payment originated, after deduction of any costs and expenses we incur in connection with the refund, including bank charges, currency conversion charges, and payment processing charges. At our discretion, we may return funds to an alternative account belonging to you, provided that you supply the documentation required to verify your ownership of that account.

17.3 Transactions are generally non-cancellable once submitted. You cannot unilaterally change or reverse a completed or pending transaction.   • A copy of the front and back of the credit or debit card used to fund your account, with the middle six digits of the card number redacted;

20. Complaints

20.1 If you have a complaint about us or our services, please contact our customer support team in the first instance at compliance@onramp.exchange. Please indicate clearly that you are making a complaint so that we can distinguish it from a general enquiry.

21. Our Liability

21.1 In the case of an unauthorised payment or a payment incorrectly executed due to our error, we will refund the payment amount including any fees deducted, as soon as practicable. This does not apply where:

21.1.1 The unauthorised payment arose from your failure to keep your account credentials secure, in which case you remain liable for the first CHF 40 of any resulting loss, unless clause 21.1.3 applies;

21.1.2 You failed to notify us without undue delay after becoming aware that your credentials had been lost, stolen, or compromised, in which case you remain liable for losses arising up to the point of notification;

21.1.3 The transaction was unauthorised but you acted fraudulently or with gross negligence in compromising your account security, in which case you bear full responsibility for all resulting losses; or

21.1.4 You failed to dispute an unauthorised or incorrectly executed transaction within 180 days of the transaction date.

21.2 Where we have failed to provide appropriate means for you to notify us of a security incident, or where we were required but failed to apply appropriate transaction authentication measures, we remain liable for the resulting losses regardless of clause 21.1 above, provided you have not acted fraudulently.

21.3 We are not liable for any loss or damage arising from: disruption to or impairment of our services caused by circumstances beyond our reasonable control; disruption to intermediary services upon which we rely; or our compliance with applicable legal requirements.

21.7 We are not responsible for the assessment or payment of any taxes, duties, or other charges arising from your use of our services.

21.8 You agree to indemnify, defend, and hold harmless MDF AG and its affiliated companies from any claims, costs, expenses (including legal fees), fines, or penalties arising from your breach of these Terms, your breach of any applicable law, or your use of our services. This obligation survives the termination of your account.

PART 7 — CHANGES, COMMUNICATION, AND GENERAL TERMS

22. Changes to These Terms

22.1 These Terms and any supplemental terms applicable to specific services are subject to change. We will provide you with advance notice of any proposed changes by sending an email to the primary email address registered to your MDF AG Account.

22.2 Proposed changes will come into effect 60 days after the date the change notice is deemed received, unless you have notified us of your objection before the changes take effect. Changes that are more favourable to you may take effect immediately if stated in the change notice. Changes to exchange rates take effect immediately without notice and are not subject to objection.

22.3 If you object to a change, the change will not apply to you; however, your objection will constitute notice to close your MDF AG Account, which will be closed in accordance with the provisions of clause 8.

24.2 The processing of your personal data is governed by our Data Storage and Privacy Policy. By accepting these Terms, you also agree to the terms of our Data Storage and Privacy Policy.

24.3 We will not share your personal data with any third party beyond what is required to fulfil our obligations under these Terms or as required by applicable law. If you receive any communication that you believe results from a breach of this requirement, please contact our customer support immediately.

25. Service Availability and Accuracy
